The following terms and conditions established by TECFRONT S.A. reflect the way PLAYS ECUADOR operates as a tourism platform, the laws we are governed by, the values and principles we declare as true, and evidence our high standards regarding regulatory compliance. Therefore, these Terms and Conditions of Service, which are the result of the implementation of an internal control framework, define the relationship that TECFRONT S.A. has with users who interact with our platform and with other users, in a specific and explicit manner.
In summary, users of our website obtain permissions to use our services, provided they agree to comply with these terms and conditions, which ultimately reflect how we work as a company and how we manage tourism in Ecuador.
When we refer to "PLAYAS ECUADOR", "the platform", "we", "us" or "our", we are referring to TECFRONT S.A. and its associated entities.
Change Notifications
If there is any event or substantial change that negatively impacts the use that the user makes of our services, or if the platform stops offering a service, or if the service is not available, it will be notified with reasonable notice, except in emergency situations, such as those intended to prevent abuse, comply with legal obligations or resolve security and operational problems.
The permission we grant to the user to use our services is valid as long as the user complies with their responsibilities, which are established and detailed in the following lines:
About Registration and User Account Management
The use of the user account is the sole responsibility of the person to whom it is assigned. The account is strictly personal and non-transferable, so it is not allowed to share it with third parties (family, friends, etc.). Each user can only log in on one device at a time. In the web version, each account can only maintain one active session. These restrictions are implemented to protect users' information and ensure proper use of the service. If non-compliance with these conditions is confirmed, or misuse of the account, it may be suspended or canceled immediately, without the right to a refund of the amounts corresponding to active services or memberships, and without prejudice to the corresponding legal actions.
The user account will be protected by a password. The password associated with the user account must follow the criteria for building secure passwords, under the parameters that we recommend when configuring your profile.
If another person demands to use the user account, you are obliged to refer to these policies and their compliance. If it is necessary to disclose the user account and change the associated password to a new one, you must request it in writing and address it to the System Administrator.
If it is detected or suspected that the activities of a user account may compromise the integrity and security of the information, access to said account will be temporarily suspended and will be reactivated only after having taken the necessary measures at the discretion of the System Administrator.
The USER can easily delete their account from their administration panel without any limitation to do so. Once the account is deleted, all data will be lost except for invoices authorized by the tax service and the information required by law.
Basic requirements to activate a user account:
Be of legal age (18 years or older);
Provide truthful, complete and up-to-date information during registration;
Expressly accept these Terms and Conditions; and
Not have been previously suspended for non-compliance with these policies.
About the Information Entered by the User in their Profile
Our platform allows users to upload, transfer, store, send, receive or share content, such as reviews, photographs, comments and recommendations about beaches and tourist destinations. Users have no obligation to provide a minimum content for the use of our services, and can freely choose the content they wish to share. If the user decides to upload or share content, they must ensure that they have the necessary rights to do so and that said content is real, truthful, verifiable and does not violate any law. Users who share content that infringes third-party rights are responsible for it and hereby release the company from liability, guaranteeing to keep it harmless.
It is not allowed to upload political or religious content, unless to express or refer to some topic related to tourism, its reference becomes necessary. In addition, it is forbidden to upload racist, discriminatory, defamatory, violent content or that may translate into conduct punishable by Ecuadorian laws.
All the information that users share and upload in their profile is subject to audit by the company, with the sole purpose of certifying the reliability of the information and guaranteeing a safe environment for all users, so censorship cannot be claimed. TECFRONT S.A. designs and applies procedures that help it obtain the appropriate information to generate reasonable conclusions and issue a fair and valid opinion.
About the Purchase of MEMBERSHIPS and Premium Services
PLAYAS ECUADOR offers different membership levels that allow users to access additional functionalities, such as exclusive content, personalized guides, discounts on tours and priority reservations.
The membership is valid for one year, counted from the date on which the payment is made, activated and the corresponding invoice is issued.
A valid credit card number or authorized payment method is required to pay for the selected membership.
Available membership levels:
BASIC MEMBERSHIP: Free - Access to general information and basic reviews.
PREMIUM MEMBERSHIP: $49 USD ANNUAL + VAT - Personalized guides, exclusive recommendations and early access to promotions.
VIP MEMBERSHIP: $99 USD ANNUAL + VAT - All Premium benefits + discounts on tours, priority reservations and exclusive content.
The USER who tries to divert traffic from our platforms to their own communication channels (email, phone, WhatsApp, website) to avoid the use of platform services will be notified with suspension and subsequent analysis by the administration, and their account may be deleted for violating the terms and conditions of service.
About User-Generated Content
PLAYAS ECUADOR is a platform that values community participation. Users can share reviews, photographs and recommendations about beaches, tourist activities, restaurants and accommodations.
All user-generated content is their sole responsibility. The platform is not responsible for the veracity, accuracy or legality of said content, but reserves the right to moderate, edit or delete any content that it considers inappropriate, false, malicious or that violates these terms.
By publishing content on the platform, the user grants PLAYAS ECUADOR a non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, modify, adapt, publish and distribute said content in connection with the operation and promotion of the platform.
About the Software in the Services
It is forbidden to copy, modify, distribute, sell or rent any part of TECFRONT S.A.'s services or software. Nor may users apply reverse engineering techniques or attempt to extract the source code of any of the products without the company's written consent.
If a service requires or includes downloadable software, that software could be automatically updated on devices when new versions or features are available. Some services allow you to configure automatic update settings.
Some of the services offered by the company include software with an open source license that is made available. Sometimes, such licenses may include terms that expressly prevail over some of these provisions, so said licenses must be reviewed in detail.
Suspend or Cancel Your Access to Services
In no case in which users decide to unsubscribe from the services or cancel their subscription or access before the end of the subscription term, will the paid and invoiced amounts be refunded. These amounts for services and subscription are understood as promotional and will not be refunded under any circumstances once the service is activated.
Similarly, in cases where TECFRONT S.A. decides to cancel a subscription and remove access to a specific account, due to violation of the terms and conditions, amounts paid by users will not be refunded.
Only in cases where due to force majeure or fortuitous event, or manifest impossibility of continuing to provide the service, TECFRONT S.A. will refund the difference between what was paid by the user and the service actually provided up to that moment.
Notification and Content Management Policy
On our platform, we value efficiency in communication and transparency in information management. Therefore, we have implemented an automatic notification system designed to ensure that users receive real-time information about news, promotions, content updates and responses to their queries. However, we recognize that automation does not guarantee that some notifications may be considered spam. Below, we detail our policy to handle such situations:
Operation of the Notification System:
When a user interacts with the platform (comments, reviews, saves favorites, etc.), the system automatically generates relevant notifications to improve their experience. This process is 100% automated and does not involve prior human intervention before sending the notification. Every notification generated is recorded in the system for audit and control purposes.
Users can configure their notification preferences from their administration panel, choosing what type of communications they wish to receive and how often.
Reception and Deletion of Unwanted Content:
The platform reserves the right to review, filter and delete any content generated by users (reviews, comments, photographs, etc.) that, at the sole discretion of the administration, may be considered false, malicious, irrelevant or constituting spam, for not meeting the minimum standards of veracity, respect or relevance.
Likewise, the user acknowledges and accepts that they may request the deletion of their own content, for which they must make a formal request in accordance with the data management and privacy policies established by the platform.
The deletion of content, whether by decision of the administration or at the request of the user, will not generate any right to compensation, refund or indemnification.
Limitation of Liability: The platform assumes no responsibility for the content generated by users, nor for any damages, losses or consequences that may arise from false, malicious or inappropriate content. Each user is solely responsible for the veracity and legality of the information they record in the system.
Commitment to Content Quality:
We are committed to continuously improving our systems to minimize the incidence of unwanted content. If we detect misuse of the platform, we reserve the right to implement additional measures, such as identity verification, access restrictions or account blocking.
About User Interaction on the Platform
PLAYAS ECUADOR promotes a respectful and collaborative community among travelers, tourists and lovers of Ecuadorian beaches. Users can interact through comments, reviews, private messages and discussion forums.
All users must maintain a respectful environment towards others, complying with minimum and basic standards of conduct based on the following values and principles: respect, integrity, truthfulness, honesty, discretion and tolerance.
The platform is not responsible for interactions between users outside its official channels. Any agreement, transaction or exchange carried out between users is their sole responsibility.
TECFRONT S.A. reserves the right to suspend or cancel user accounts that repeatedly fail to comply with coexistence rules or that receive multiple justified complaints from other users.
Reservations and Purchases Services
In the future, PLAYAS ECUADOR may offer tour, accommodation, transportation and tourist activities reservation services directly through the platform. In such case, specific policies will apply for each service, including cancellation terms, refunds and responsibilities.
Transactions made through the platform will be subject to Ecuadorian laws, including consumer protection regulations and the Organic Law on Personal Data Protection.
Any dispute related to third-party services (tour operators, hotels, etc.) will be the responsibility of the service provider, although the platform will facilitate communication to resolve incidents in a friendly manner.
General Provisions
The Law grants certain rights that cannot be limited by a contract such as these terms and conditions of service. The purpose of these terms is in no case to restrict these rights. These terms describe the relationship between users and TECFRONT S.A. They do not create any legal right for other persons or organizations, even if they benefit from said relationship by virtue of these terms. We want these terms to be easy to understand, so we have used examples about the services. Some of the services mentioned may not yet be available depending on your user role on the platform.
In case of conflict between these general terms and conditions and the specific additional terms incorporated into a particular service, the latter shall prevail.
In the event that a particular term or condition is not valid or enforceable, the remaining terms will not be affected.
Failure to comply with the terms and conditions detailed herein or with specific additional terms of the services, which does not lead to the taking of an immediate enforcement measure by TECFRONT S.A., cannot in any way be understood as a waiver of the rights of the company, for example, to take action in the future.
TECFRONT S.A. may update these terms and conditions and the specific additional terms of a particular service to reflect modifications that occur in its services or in its way of doing business; for example, when adding services, features, technologies, prices or benefits (or removing obsolete ones); for legal, regulatory or security reasons; or to prevent abuse or harm.
If these terms and conditions or the specific additional terms of the services are substantially modified, they will be duly notified in advance and users will have the opportunity to review the changes, except for the launch of a new service or new feature; or in urgent situations, such as those intended to prevent continued abuse or respond to legal requirements. If you do not agree with the new terms, you may withdraw your content and stop using the corresponding services at any time and delete your account.
